Legal counsel has advised with regard to COVID-19 and the health and safety of our residents, insurance considerations impacting homeowner associations in general, and potential liability to our Association as a whole. Legal counsel also provided recommendations and a list of specific applicable factors to take under consideration when a homeowner association formulates their unique plan to possibly re-open their pool and other amenities. The plan if/when implemented must include a means to effectively maintain and enforce these specific requirements.
Part of Legal Counsel’s recommendation is to take the lead from Manatee County and keep the pool and other amenities closed at least until, and possibly beyond, the date that the Manatee County Board of Commissioners decide to re-open the county pools, playgrounds and sports courts. At this point, most Manatee County pools, playgrounds and sports courts remain closed.
The Board has a fiduciary responsibility to analyze and mitigate all potential liabilities. The HOA Board, and we as an HOA community, must take all recommended precautions to protect the health and safety of all our residents.
We thank you for your understanding as we have to make these very disappointing, yet necessary decisions on behalf of the community.
